Evaluation of a Psychoeducational Program to Help Adolescents Cope

Over 20% of a sample of 706 young adolescents identified themselves as experiencing difficulties and being in need of specific help in coping. A psychoeducational Program Helping Adolescents Cope was offered to 112 of those. This was adapted, with permission, from the Coping with Stress Course, devised by Albano et al. (1997). Participants progress was monitored and evaluated using qualitative and quantitative measures. The psychoeducational Program was found to be significantly effective in reducing participants depression scores, in reducing their reliance on unproductive means of coping and overall in helping them cope. This article presents the methodology used, key results and discusses the implications of this work for professionals working with adolescents in the area of prevention and coping.Claire Hayes is a clinical and educational psychologist who has recently moved from her post of lecturer in the National University of Ireland Maynooth to develop the Break through Anxiety service as a private practitioner. Community Penalties in the United States

The author discusses some background matters concerning the US criminal justice systems that may provide useful context for non-US readers, and summarises the main general conclusions about the operation of community penalties from two decades' research. He also briefly summarises research concerning each of the major penalties that have been attempted. Why American jurisdictions have been comparatively unsuccessful at use of community penalties as alternatives to incarceration and whether that lack of receptivity can be changed is discussed in the conclusion.     

An Evaluation of the Use of Videotaped Evidence for Juvenile Witnesses in Criminal Courts in England and Wales

For the first time, the UK Criminal Justice Act (1991) allowed the videotaped evidence of a child to be substituted for the child's evidence-in-chief in a criminal court. The present study is an evaluation of that legislation. One hundred and fifty children were observed testifying in a criminal court in the UK. The use of the videotaped evidence and subsequent cross-examination of the child witness (usually via the closed circuit television system) was also observed. The data base from the Lord Chancellor's Department of all trials involving child witnesses in England and Wales was also analysed. The results showed that the introduction of the video technology into the criminal courts reduced the levels of stress of child witnesses but did not increase the conviction rates.     

新“消法”对消费者公益诉讼限制性适用之评析

2013年修订的《消费者权益保护法》增加了关于消费者公益诉讼制度的规定。立法者对该制度做了一系列规范性的限制。该规定在防止滥诉的同时,也在一定程度上限制了消费者公益诉讼功能的发挥,妨碍了消费者利益的有效救济。在此背景下,不妨考虑对消费者公益诉讼进行非规范性的限制,即通过完善传统的私益诉讼等其他救济路径,间接限制公益诉讼的适用。该做法既不影响公益诉讼的适用,又有利于其他维权方式的进一步完善,从而推动消费者维权制度的发展。

犯罪的严重性是犯罪的客观危害与主观恶性的统一,它构成决定刑罚的分配的重要基准.对犯罪的严重性的评价应该以体现犯罪的客观危害与主观恶性的所有因素为标准.对犯罪的客观危害的评价应该考虑犯罪所侵害的权益的意义、犯罪的危险的大小、所造成的实际损害的轻重、犯罪的对象、时间、地点与实施程度;对犯罪的主观恶性的评价应该考虑犯罪的罪过形式、犯罪的动机与目的、认识的内容、犯罪的起因、犯罪人的生理与精神状况、犯罪人的身份以及犯罪人在犯罪中的表现.鉴于作为犯罪的严重性的组成部分的客观危害与主观恶性构成既统一又对立的关系,对犯罪的严重性的统一评价应该相应地遵循对立统一律.     

群体性事件处置中“慎用警力”原则研究

在处置群体性事件中，必须讲究政策、讲究策略、讲究方法，坚持“三个慎用”原则。其中，“慎用警力”原则主要适用于非警务活动。非警务活动是公安部的通知通告中出现的非正式用语。当前，我国一些地方公安机关非警务活动所占时间比例已经超越了正常的警务工作时间。应当严禁公安机关违反规定从事非警务活动。进一步规范各类非警务活动。非警务活动的形成渊源有两个：服务型警务和地方政府利益。“镇用警力”原则的具体表现为合理用警、规范用警。
